1.Background
Internet is
the driving force towards business, education and social applications and
Internet Domain name plays a key role in it. National Internet Exchange of
India (NIXI) has been set up to facilitate exchange of domestic Internet
traffic within the country by the Internet Service Providers (ISP).
NIXI has
been entrusted with the responsibility of setting up the Registry for .IN
ccTLD. The technical and business activities of the .IN Registry will
operate from NIXI office at Software Technology Park of India (STPI), Noida.
NIXI has ambitious plans to provide impetus to .IN domain registrations in
the country.
Keeping this
in view, NIXI proposes to appoint a panel of Indian Arbitrators with
international experience for providing their services in case of disputes
regarding .IN domain names in the country. Accordingly, NIXI invites
proposal from interested parties who have proven expertise in the area of
domain name Arbitration. The .IN domain dispute resolution will broadly
follow the principles defined in Internet Corporation for assigned Names and
Numbers(ICANN’s Uniform Dispute Resolution Policy (UDRP).
The chosen
panelists will provide their services as Arbitrators in case of .IN domain
name disputes that the complainants choose to bring before the .IN
arbitration forum set up by NIXI. The chosen panelists should fulfill the
eligibility criteria as per the following:
2. Eligibility criteria
2.1 Indian Origin
The panelists must be
citizens of India. The Arbitrators must not have any criminal record neither
must there be any such proceedings pending against them.
2.2 Legal
Background
The panelists must have a
legal background and must have a standing of minimum at least 10 years as an
advocate enrolled with the Bar council.
2.3 Dispute
Resolution Knowledge
An overview of the
panelist’s capabilities and background in providing dispute-resolution
services, including a description of the panelist’s track record of handling
the procedural aspects of dispute resolution proceedings.
The chosen panelists must
be conversant with trademark and other intellectual property laws prevailing
in India, including the Information Technology Act, 2000 and relevant
Cyberlaw issues pertaining to domain names.
A description of the qualificationsand experience of the panelists should
be submitted. The panelist should possess an understanding of the Domain
Name arbitration process as followed by ICANN accredited service provider
for UDRP like the World Intellectual Property Organisation (WIPO).
If the panelist is currently serving on a domain name arbitration panel,
documentary evidence of such position should be provided.
2.4 Proposed Operating Procedures
Documentation of the
panelist’s proposed internal operating procedures.
A description of how the
panelist proposes to administer proceedings, including its interaction with
registries, registrars, .IN Registry, and other approved domain name dispute
resolution providers.
2.5 Publication of Decisions
Description of how the panelist intends to publish decisions of panels in
proceedings it administers. Panelists should have a website for
communication of the status of proceedings, which should be kept up-to-date.
2.6 Capacity
Description of a proposed timetable for panelist’s implementation of a
program for administering domain name dispute resolution proceedings,
including a statement of the panelist’s administrative capacity in terms of
number of proceedings capable of being handled on a monthly basis.
Documentation Required
All documentations
in support of the eligibility criteria must be filed along with expression
of interest proposal.
